Terms & Conditions

1. Introduction

Welcome to TuloyTulay (the “Platform”), accessible at tuloytulay.org. These Terms & Conditions (“Terms”) govern your access to and use of the Platform, which connects community members, mentors, volunteers, and partner organizations across the Philippines. By creating an account or otherwise using the Platform, you agree to these Terms.

2. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines, including but not limited to:

  • Republic Act No. 10173 — Data Privacy Act of 2012 and its Implementing Rules and Regulations (IRR), as enforced by the National Privacy Commission (NPC);
  • Republic Act No. 8792 — Electronic Commerce Act of 2000, on the legal recognition of electronic documents, signatures, and transactions;
  • Republic Act No. 10175 — Cybercrime Prevention Act of 2012;
  • Republic Act No. 7394 — Consumer Act of the Philippines;
  • Republic Act No. 8293 — Intellectual Property Code of the Philippines;
  • Republic Act No. 11765 — Financial Products and Services Consumer Protection Act, where applicable;
  • Republic Act No. 9995 — Anti-Photo and Video Voyeurism Act of 2009;
  • Republic Act No. 9775 — Anti-Child Pornography Act of 2009; and
  • Republic Act No. 9262 — Anti-Violence Against Women and Their Children Act of 2004, where relevant to protection of beneficiaries.

The proper venue for any dispute arising from these Terms shall be the competent courts of the National Capital Judicial Region, Philippines, without prejudice to any alternative dispute resolution mechanisms under Philippine law.

3. Eligibility

You must be at least 18 years old, or the legal age of majority in your jurisdiction, to create an account on TuloyTulay. Minors may only be enrolled as beneficiaries through a parent, legal guardian, or accredited partner organization acting in loco parentis, consistent with the Family Code of the Philippines and applicable child-protection laws.

4. Accounts, Roles, and Validation

The Platform supports the following roles: Beneficiary, Mentor / Volunteer, Partner, Partner Admin, and Super-Admin. Certain roles require verification and validation by TuloyTulay or an authorized Partner Admin. You agree to provide accurate and current information, to keep your credentials confidential, and to be responsible for all activity under your account.

5. Acceptable Use

You shall not use the Platform to:

  • Violate any law of the Republic of the Philippines, including RA 10175 (Cybercrime Prevention Act);
  • Upload, post, or transmit content that is unlawful, defamatory, obscene, discriminatory, or that infringes intellectual-property rights;
  • Misrepresent your identity, role, organization, or community affiliation;
  • Collect, process, or disclose another user’s personal data outside the purposes permitted by the Data Privacy Act;
  • Use the Platform to solicit donations, payments, or commercial transactions outside officially sanctioned programs;
  • Interfere with or compromise the security, integrity, or availability of the Platform.

6. Data Privacy

TuloyTulay processes personal data in accordance with the Data Privacy Act of 2012 (RA 10173) and its IRR. Our collection, use, storage, sharing, retention, and disposal of personal data, as well as the rights of data subjects (right to be informed, to object, to access, to rectify, to erasure or blocking, to damages, and to data portability), are described in our Privacy Policy. By using the Platform, you acknowledge that you have read and understood the Privacy Policy.

Beneficiary information, needs assessments, and impact data are treated as sensitive personal information and are accessible only to the beneficiary, their assigned mentor, the Partner Admin of organizations whose scope covers the beneficiary’s community, and authorized super-admins, subject to Row-Level Security controls.

7. Cookies

The Platform uses cookies and similar technologies for authentication, session persistence, security, and aggregate analytics. Continued use of the Platform after accepting the cookie notice constitutes consent under NPC Advisory No. 2017-01 and the Data Privacy Act. See our Cookie Policy for details.

8. Intellectual Property

All trademarks, logos, source code, documentation, and content on the Platform are owned by TuloyTulay or its licensors and are protected under the Intellectual Property Code (RA 8293). You retain ownership of content you submit but grant TuloyTulay a non-exclusive, royalty-free, worldwide license to host, display, and process such content solely to operate and improve the Platform.

9. Electronic Transactions and Signatures

Consents, agreements, and submissions made through the Platform are recognized as valid electronic documents and electronic signatures under the Electronic Commerce Act of 2000 (RA 8792) and the Rules on Electronic Evidence.

10. Third-Party Services

The Platform integrates with trusted infrastructure providers (e.g., Supabase via Lovable Cloud for database and authentication, Cloudflare for edge delivery). These providers act as personal information processors under contractual safeguards consistent with the Data Privacy Act.

11. Disclaimers and Limitation of Liability

The Platform is provided on an “as is” and “as available” basis. TuloyTulay does not guarantee that the Platform will be uninterrupted, secure, or error-free. To the maximum extent permitted by Philippine law, TuloyTulay and its volunteers, partners, and contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Platform.

12. Suspension and Termination

TuloyTulay may suspend or terminate your access to the Platform at any time for violations of these Terms, applicable law, or upon legitimate request of authorized partner organizations. You may close your account at any time by contacting us.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the Platform or by email. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
